Terms and Policies

1. Cancellation, refunds, and transfers

If you are taking a course to satisfy a requirement, PBI Education urges you to seek pre-approval and confirm your course date PRIOR to registration.

  • Courses thirty (30) days or more from commencement are eligible for a refund, less a 10% processing fee. All refund requests must be received in writing.
  • Courses twenty-nine (29) days or less from commencement are not eligible for a refund or date transfer.
  • No refunds are offered for on-demand or teleconference courses.
  • Date transfers may be requested for courses thirty (30) days or more from commencement. All date transfers are subject to a $200 transaction fee.

All notifications of cancellation, date transfer request, and request for refund must be made in writing, via email or fax to PBI Education. Any approved refunds are subject to a 10% processing fee. If a date transfer request is granted, a maximum of one date transfer is allowed. Transferred courses are not eligible for a refund. Refunds will only be issued by way of the original payment method with which the order was placed. Prior to disputing a charge, we request that you contact PBI Education to discuss the available options for your registration. Once a dispute is formally filed with your bank or card issuer, alternative resolutions are no longer available. 

2. Confidentiality agreement

I understand that private, personal, confidential, and proprietary information (collectively, “Confidentiality Information”) may be discussed during my live or teleconference seminar (each a “Seminar”).  “Confidential Information” includes, but is not limited to, any communications, oral or written, among the students and faculty, and written material prepared by PBI Education, its faculty or employees that is not ordinarily known by non-employees of PBI Education, including, programs, products, data, know-how, designs, sketches, photographs, graphs, drawings, ideas, research, computer software and programs (including object code and source code), computer software and database technologies, systems, structures and architectures (and related processes, formulae, composition, improvements, devices, know-how, inventions, discoveries, concepts, ideas, designs, methods and information), training techniques and materials, however documented, obtained from PBI Education’s documents, property or discussions with any member of the PBI Education faculty irrespective of the form of the communication, and also includes all notes, analyses, compilations, studies, summaries and other material prepared by PBI Education or its representatives containing or based, in whole or in part, upon any information included in the foregoing, and shall include all such Confidential Information you receive from PBI Education at any time prior to or after the date of this Agreement. All information I learn about other individuals who are taking the Seminar is considered Confidential Information. Any Confidential Information that is a trade secret of PBI Education will also be entitled to all of the protections and benefits under Florida trade secret law and any other applicable law.  If any information that PBI Education deems to be a trade secret is found by a court of competent jurisdiction not to be a trade secret for purposes of this Agreement, such information will in any event still be considered Confidential Information for purposes of this Agreement.

The discussion of any Confidential Information at any Seminar shall remain private and confidential; I agree that I will keep all Confidential Information confidential after attending the Seminar and I will not disclose, use or duplicate the Confidential Information disclosed to me or reverse engineer, disassemble or decompile any Confidential Information except with the express written consent of PBI Education. I understand that I may be required to disclose Confidential Information if mandated by reporting requirements, as dictated under laws of a particular jurisdiction, or as otherwise mandated by law. The faculty presenting any Seminar may share any Confidential Information amongst themselves and with PBI Education and its staff before, during, or after the Seminar to better facilitate the seminar process.

PBI Education makes no warranty or representation of any kind concerning Confidential Information, except that it has the right to disclose Confidential Information to you. Confidential Information is provided only for discussion purposes on an “AS IS” basis.

I agree to indemnify and hold the entities that provide accreditation for PBI Education courses, PBI Education, and its faculty, directors, officers, staff, agents, and independent contractors harmless for the release of any Confidential Information (whether mandated by law or otherwise) and any damages, losses, costs, or liabilities arising from, related to, or connected with my release of Confidential Information, including, but not limited to, any attorneys’ fees, judgments, fines, and amounts paid in settlement actually and reasonably incurred by any indemnitee. Any indemnification to be provided to any indemnitee shall be made on an after-tax basis, after accounting for all taxes due with respect to such indemnification so that the indemnitee is revenue-neutral on an after-tax basis after the payment of taxes with respect to such indemnification. In addition, because an award of money damages (whether pursuant to the foregoing sentence or otherwise) would be inadequate for my breach of this Agreement, and any such breach would cause PBI Education irreparable harm, I also agree that, in the event of any breach or threatened breach of this Agreement, PBI Education will also be entitled, without the requirement of posting a bond or other security, to equitable relief, including injunctive relief and specific performance. Such remedies will not be the exclusive remedies for any breach of this Agreement but will be in addition to all other remedies available at law or equity to PBI Education.

I waive any claims against PBI Education arising from, related to or connected with the release of any Confidential Information by a third party not under the control of PBI Education. PBI Education may contact my regulatory agency, organization, or professional school (collectively, my “Organization”) to facilitate the course process and to disclose relevant information to my Organization at the discretion of PBI Education faculty and staff. I understand that under the following circumstances, I will be considered by PBI Education as having been referred to the course, regardless of who has paid for the course fees: 

  • Course enrollment is found to be initiated upon referral, recommendation, suggestion, or otherwise communicated by a referring entity 
  • Referring entity contacts PBI Education directly, prior to or after my registration, and provides my name in reference to or in conjunction with my course, either with or without my knowledge of the referring entity’s disclosure
  • Available public documentation from my regulator refers to course participation

If PBI Education is required by law to release information obtained from or disclosed by me, PBI Education will notify me of the mandate and the nature of the information required by the mandate in connection with any mandatory reporting obligation.

I understand that PBI Education reserves the right to disclose my private, personal, and confidential information at its discretion, should it believe that there is an immediate threat to the safety or well-being of the public or me. I agree that PBI Education may contact my Organization should any of the following behaviors be observed and/or discovered before, during, and/or after my course:

  • Threat to self or others;
  • Impairment, psychosis, and / or other psychiatric issues that could impact the safe practice of medicine or teaching;
  • Poor or inconsistent attendance;
  • Disruptive and/or unprofessional conduct;
  • Harassment of any kind;
  • Failure to complete the course including non-compliance with assignment completion or submission, if my course has been taken under order or agreement; and
  • Breach of confidentiality.

I also agree that upon request of my Organization, PBI Education may issue an Accomplishments, Impressions, and Recommendations (AIR) Letter to my Organization following my participation in any course offered by PBI Education if I have signed the applicable release form. I further agree and covenant not to institute any action, administrative action, or suit, or file any complaint against PBI Education related to, connected with, or arising from the release or exchange of information with any state, federal or local court or governmental agency arising from, related to, or connected with any conduct allegedly engaged in during the course of my relationship with PBI Education.

A disclosure by PBI Education pursuant to the preceding statement is not a breach of this Confidentiality Agreement.

3. Professionalism, course credit, and participation

A violation of professionalism will result in expulsion without refund and, when warranted, a formal report being made to the participant’s regulatory board/agency at the discretion of PBI Education. Violations of professionalism include, but are not limited to, the following:

  • Aggressive, disruptive, bullying, offensive, threatening, or harassing behavior towards PBI Education, its faculty, directors, officers, staff, agents, and independent contractors, or other participants 
  • Cheating or plagiarizing any work which is required to be prepared or submitted in connection with the course, or during any examination taken in connection with the course
  • Stealing or acting in a fraudulent or deceitful manner towards PBI Education, its faculty, directors, officers, staff, agents, and independent contractors, or any other participants

Successful completion of a course is not guaranteed. Certificates may be withheld as needed without refund. Determination of successful course completion is at the discretion of PBI Education faculty and staff, in accordance with course accreditation standards and the standards outlined in the course agenda. These standards include, but are not limited to, full and active participation in all components of the course and comprehension of the course material as demonstrated through the ability to achieve the learning objectives.

Partial attendance of any course is not allowed. If a participant registers for a course and does not complete the required pre-course assignments by the deadline, or only attends partially, a certificate will not be issued. In this instance, course fees will be forfeited and will not be eligible for refund or transfer. 

If a participant arrives late or leaves early from a live course the participant’s certificate will not be released. If the missed time in class is significant, the attendee will be required to pay the course fees again and repeat the course entirely.

Participants are responsible for signing in promptly during the specified times to ensure their attendance is accounted for. 

4. Intellectual property agreement

I understand that all course materials, course content, and course discussion are considered proprietary intellectual property and are intended for my personal, educational use only. I understand that breach of any of the following will result in my expulsion without refund and a formal report to my regulatory board/agency. I agree that I will not: 

  • Screenshot, copy, modify, reproduce, re-publish, re-present, record, relay, sub-license, sell, upload, broadcast, post, share, transmit or distribute any of the course material, assignments, content, methodology, or discussion
  • Use the course materials, course content, or course discussions in the provision of any other course or training 
  • Remove any copyright or other notice of PBI Education on the course materials or course content 

5. On-demand and teleconference courses

Attendees shall complete all teleconference and on-demand courses within eight (8) months of the date of their registration. For those enrolled in an Extended Edition course, the MAS-12 teleconference component shall be completed no later than eight (8) months from the live course’s completion date. If an attendee does not complete the course within the specified time frame, then the course registration will expire and no refund will be granted. PBI Education is not responsible for reminding attendees to complete assignments or finish their course in a timely manner.

6. Eligibility and preexisting relationships

PBI Education has the right to refuse to provide service/admission to a candidate for any reason or no reason, in our sole and absolute discretion. If you are not an educator or healthcare professional but you would like to attend a course, you will need to seek written approval from PBI Education prior to registration. Please be transparent with your intentions and reasons for taking this particular course. PBI Education is not responsible for any additional expenses (e.g., hotel, travel, rentals) incurred without written approval from PBI Education.

Taking a course on the same date as someone you knowingly have a preexisting relationship with (e.g., significant other, relative, colleague, legal counsel, friend, etc.) is not allowed unless prior written permission has been granted by PBI Education. Due to the confidential and sensitive nature of courses, existing personal relationships with other participants can compromise the quality and impact of the educational experience. PBI Education does everything in its power to neutralize known conflicts of interest between participants and faculty in advance of course commencement. However, upon course commencement, if you become aware that you have a preexisting relationship with either your PBI Education faculty or another course participant it is your responsibility to notify PBI Education immediately so we can discuss resolutions.

7. Course rescheduling

PBI Education reserves the right to cancel or reschedule any event due to unforeseen circumstances or insufficient registration, and PBI Education will refund fees for any canceled event. Upon your request, PBI Education will also refund course fees if the event is rescheduled or the location is changed, and you must cancel your registration due to the change. PBI Education shall have no further liability.

8. Payment method

If you make a purchase from PBI Education using a payment card or account in another persons name you will need to get this person’s permission. If you use someone else’s payment card or account without permission, PBI Education will consider this transaction fraudulent. PBI Education has zero tolerance for fraud and retains the right to report fraudulent actions to the proper authorities including regulatory agencies and professional schools. PBI Education will not be held not responsible for any legal or disciplinary action taken by regulatory agencies. PBI Education reserves the right to decline a registrant from all future courses.
